Exemption from Payment of Earnest Money Deposit (EMD) in respect of Tenders called for by Government Departments

Finance Department has issued Order, Order No G.O.(Ms)No.126 Dated : 11.4.2007 for Exemption from Payment of Earnest Money Deposit (EMD) in respect of Tenders called for by Government Departments, State Owned Corporations, Boards, etc. In Ref of G.O.Ms. No.387, Finance (BPE) Department, Dated: 03.08.1998.
In reference to the above subject matter the Order Issued by the Government are as below.

ORDER

The Rural Development and Panchayat Raj Department has requested for issue of orders, exempting the Self Help Groups (SHGs) from paying the Earnest Money Deposit / Security Deposit the cost of Tender Forms and other connected documents citing such concession to Small Scale Industrial units in respect of tenders called for by the State Government Departments / State Owned Public Sector Undertaking etc., and to issue necessary exemption under the TamilNadu Transparency in Tenders Act, 1998, in this regard.

2. As per the provisions of sub – rule (1) of rule 14 of the Tamilnadu Transparency in Tenders Rules, 2000 any category of tenderers can be specifically exempted by the Government from the payment of earnest money deposit. In the Government Order read above, among otherthings exemption has been granted from the Payment of Earnest Money Deposit to the Small Scale Industrial (SSI) Units registered with TamilNadu Small Industries Development Corporation (SIDCO) or National Small Industries Corporation (NSIC) in respect of those items for which the Registration Certificate has been obtained in respect of tenders called for by Government Departments, State Owned Public Sector Undertakings, Statutory Boards, Local Bodies and Co-operatives. On the same analogy, under sub – rule (1) of rule (14) of the TamilNadu Transparency in Tenders Rules, 2000 the Government specifically exempt the Self Help Groups (SHGs) who have passed the first as well as second grading conducted by the Project Officer (Mahilir Thittam), District Rural Development Agency from Payment of Earnest Money Deposit (EMD) in tenders called for by the State Government, State Owned Boards and Corporations etc., in respect of products actually manufactured by them or in respect of services actually rendered by them directly. The exemption will be made available for a period of one year and will be reviewed at the end of one year and suitable decision for further extention of the exemption will be considered based on the usefulness of such exemption.

Inviting & Opening of Tenders

The award of Public Contract through open tender is to ensure - transparency in public procurement, to maximize economy and efficiency in public procurement, to promote healthy competition among tenderers, to provide for fair and equal treatment to all the tenderers and to eliminate irregularities, interference and corrupt practices by authorities concerned. This is also required by the Article 14 of the Constitution of India.

Normally three modes of tendering are adopted. Namely -
  • Open Tenders
  • Limited Tenders
  • Single Tender/Nomination Basis

In an open tender, bids are invited giving wide and adequate publicity. This is the most preferred mode of tendering.

In the case of small value works, urgent works and in case only a few bidders are available in the market, limited tenders from such bidders who have been empanelled are invited. In case of Limited Tenders the empanelment should be done in a transparent way and updated periodically.

Award of contracts on nomination basis, which is also called a single tender is to be resorted to only under exceptional circumstances such as natural calamities and emergencies or there were no bids to repeated tenders or where only one supplier has been licensed ( proprietary item ) in respect of goods sought to be procured.

In one of the recent judgments of the Hon’ble Supreme Court in case of Nagar Nigam, Meerut Vs Al Faheem Meat Exports Pvt. Ltd. it has been emphasized that all the public tenders should be in an open and transparent manner with adequate publicity. In this judgment, Hon’ble Supreme Court has stressed that award of contract on nomination basis should be resorted to in rare and exceptional cases only

The Commission vide its Circular No. 06-03-02-CTE-34 dt. 20.10.2003 and Circular No. 15/5/06 issued vide letter no. 005/CRD/19 dt. 9th May 2006 has emphasized upon open tendering as the most preferred mode of tendering and insisted on transparency in the preparation of panel in case of limited tenders.

During intensive examination of various contracts a warded by many organizations, it is observed that they do not have a clear-cut policy for inviting tenders through various modes as discussed above.

The Odisha Industries (Facilitation) Act 2004 has been enacted to provide single window clearances so as to reduce transaction costs and times for investors. The High Level Authority chaired by the Chief Minister and State Level Authority chaired by Chief Secretary have been constituted to consider investment proposals and accord clearances. Industrial Promotion and Investment Corporation of Orissa Limited (IPICOL) and Odisha Industrial Infrastructure Development Corporation (IDCO) have been entrusted with multi-faceted roles of investor support. At the District level, the General Managers of District Industries Centres (DIC) have similar roles.
   
Odisha is the State where clear Purchase Policy is available. As per the Purchase Policy of the State Government under Industrial Policy Resolution, 2001, Items other than those in the “Exclusive Purchase List” or on “Rate Contract” may be purchased by the State Government Departments and Agencies under the control of State Government through open Tender. Local small scale industrial units and khadi & village industrial units (including handloom & handicrafts) competing in the open tender will be entitled to price preference as in paragraph 2. (III) of purchase Policy.

Pre-requisite for operating on the e-Procurement System of Government of Madhya Pradesh

System auto approves new registration and it’s the responsibility of the bidder to ensure that details filled at the time of registration are correct. E-Procurement service provider will not be responsible in case of misrepresentation of facts and details.The enrollment of the Bidder shall be valid for a period of One (1) Year from the date of approval of the enrollment. After the expiry of the period, the enrollment shall have to be renewed with an application of renewal.

Special Instructions to the Contractors/Bidders for the e-submission of the bids online through this tender site

  1. Bidder should do the registration in the tender site https://jharkhandtenders.gov.in using the option available.Then the Digital Signature registration has to be done with the e-token, after logging into the site. The e-token may be obtained from one of the authorized Certifying Authorities such as SIFY/TCS / nCode.
  2. Bidder then login to the site thro’ giving user id / password chosen during registration.
  3. The e-token that is registered should be used by the bidder and should not be misused by others.
  4. The Bidders can update well in advance, the documents such as certificates, purchase order details etc., under My Documents option and these can be selected as per tender requirements and then send along with bid documents during bid submission.
  5. After downloading / getting the tender schedules, the Bidder should go thro’ them carefully and then submit the documents as asked, otherwise, the bid will be rejected.
  6. If there are any clarifications, this may be obtained online thro’ the tender site, or thro’ the contact details. Bidder should take into account of the corrigendum published before submitting the bids online.
  7. Bidder, in advance, should get ready the bid documents to be submitted as indicated in the tender schedule and they should be in PDF/xls/rar/dwf formats. If there is more than one document, they can be clubbed together.
  8. Bidder should get ready the EMD as specified in the tender. The original should be posted/couriered/given in person to the Tender Inviting Authority, within the bid submission date & time for the tender.
  9. The bidder reads the terms & conditions and accepts the same to proceed further to submit the bids
  10. The bidder has to submit the tender document online well in advance before the prescribed time to avoid any delay or problem during the submission process.
  11. After the bid submission, the acknowledgement number, given by the e-tendering system should be printed by the bidder and kept as a record of evidence for online submission of bid for the particular tender.
  12. The details of the Earnest Money Deposit document submitted physically to the Dept and the scanned copies furnished at the time of bid submission online should be the same otherwise the Tender will be summarily rejected
  13. The Tender Inviting Authority (TIA) will not be held responsible for any sort of delay or the difficulties faced during the submission of bids online by the bidders.
  14. The bidder may submit the bid documents either by online mode through the site (https://jharkhandtenders.gov.in) or by manual mode to the TIA as indicated in the tender. If a bidder submits the bid, both online and in manual form, only the online bid will be acceptable.
  15. The tendering system will give a successful bid updation message after uploading all the bid documents submitted & then a bid summary will be shown with the bid no, date & time of submission of the bid with all other relevant details. The documents submitted by the bidders will be digitally signed using the e-token of the bidder and then submitted.
  16. The bid summary has to be printed and kept as an acknowledgement as a token of the submission of the bid. The bid summary will act as a proof of bid submission for a tender floated and will also act as an entry point to participate in the bid opening date.
  17. Bidder should log into the site well in advance for bid submission so that he submits the bid in time i.e on or before the bid submission end time. If there is any delay, due to other issues, bidder only is responsible.The bidder should see that the bid documents submitted should be free from virus and if the documents could not be opened, due to virus, during tender opening, the bid is liable to be rejected
  18. The time settings fixed in the server side & displayed at the top of the tender site, will be valid for all actions of requesting, bid submission, bid opening etc., in the e-tender system. The bidders should follow this time during bid submission.
  19. All the data being entered by the bidders would be encrypted using PKI encryption techniques to ensure the secrecy of the data. The data entered will not viewable by unauthorized persons during bid submission & not be viewable by any one until the time of bid opening. Overall, the submitted tender documents become readable only after the tender opening by the authorized individual.
  20. The confidentiality of the bids is maintained since the secured Socket Layer 128 bit encryption technology is used. Data storage encryption of sensitive fields is done.
  21. The bidders are requested to submit the bids through online e tendering system to the TIA well before the bid submission end date & time (as per Server System Clock).
  22. The bidder should logout of the tendering system using the normal logout option available at the top right hand corner and not by selecting the (X) option in the browser.
  23. If the bidder submits the bid in manual form, he should have already registered in the tender site and he has to inform the registration ID in the bid submitted otherwise his tender will not be considered.

The two cheapest sources of thermal power generation – coal and natural gas – are in abundance.

In 2004–2005, Andhra Pradesh was at the second position in the list of top information technology exporting states of India. The IT sector is expanding at a rate of 52.3% every year. The IT exports reached  19,000 crore (US$3.5 billion) in 2006–2007, contributed to 14 per cent of total IT exports of the nation and ranked fourth in India.[58] Other key sectors include, Biopharmaceuticals, Power, Automobile, Tourism, Textiles, Retail, Leather, and Mining and Religious tourism.
